Education and Continuing Professional Development (CPD) Courses Terms & Conditions

The Pharmacy Guild of Australia (PGA) provides a number of training courses in a variety of formats (Courses). By registering for a Course, you agree to be bound by the terms and conditions set out below.

  1. Registration and Payment

    (a) PGA may accept or decline your application to register for a Course for any reason (for example, if the Course has reached capacity).

    (b) Upon successful submission of your registration form, a confirmation of registration and tax invoice will be sent to your email address (as set out in your registration form) within 24 hours. Please contact the Education and Workplace Relations Division of PGA's Queensland Branch on (07) 3831 3788, or email education@qldguild.org.au if you do not receive a confirmation email within this timeframe.

    (c) You must pay all course registration fees in full when registering for a Course.

    (d) Credit card payments are made directly through NAB Transact to ensure your personal details are kept safe. None of your payment details are stored by PGA.

  2. Changes, Cancellations and Refunds
    1. Changes or cancellation by PGA

      PGA reserves the right to:

      (a) cancel any Course at any time and for any reason. If you have already paid for a Course that is cancelled by PGA, PGA will provide you with either:

      (i) a credit, in the amount of the fees paid for the Course, that can be applied toward another Course (Transfer Credit); or

      (ii) a full refund; and/or

      (b) postpone and/or change any Course at any time and for any reason (for example, in relation to the time or location). If this occurs, PGA will use its reasonable endeavours to notify you of the change. If you have already paid for a course that is subject to a change under this clause 2.1(b) and that change prevents you from attending the Course, PGA will provide you with either:

      (i) a Transfer Credit; or

      (ii) a full refund; and

      (c) remove you from any Course at any time (including cancelling your registration), or take any other action if, in PGA's opinion, such action is reasonably necessary (including for non-compliance with these terms and conditions).

    2. Changes or cancellation by you

      (a) (Cancellation) If you wish to cancel your Course registration, you must notify PGA in writing at least seven business days prior to the commencement of the Course. If you notify PGA within this timeframe, you may choose to receive either a full refund or a Transfer Credit. Cancellation requests made within 7 business days of the commencement of the course will not receive a refund.

      (b) (Postponement) If you are unable to attend a Course that you have registered for, you may request a Transfer Credit. You must notify PGA of such a request at least one business day prior to the commencement of the relevant Course.

      (c) (Substitution) Another person may attend a Course that you have registered for instead of you. You must notify PGA of the substitution before the commencement of the relevant Course, and the new participant must register for that course in accordance with clause 1(a) above by that same date.

      (d) (No-shows) If you register for a Course but do not attend (and do not notify PGA), any fees that you have paid in respect of that Course will be forfeited.

    3. Transfer Credits

Transfer Credits must be used within 12 months of the commencement date of the Course in respect of which the Transfer Credit was issued. After such date, Transfer Credits expire and cannot be used.

    1. Third party venues

      Where a Course is conducted at a third party venue, you must comply with any terms of that venue (and any reasonably directions of PGA or the venue host) in connection with the Course.

    2. Disclaimer

      You agree that PGA is not liable to you for any loss, damage, injury or any incidental, indirect, special, consequential or economic loss or damage (including loss of opportunity, exemplary or punitive damages) whether to person or property and whether arising from default, negligence, misconduct or otherwise by PGA, its employees, agents or contractors in connection with any Course.

    3. Indemnity

      You agree to indemnify PGA against liability for, or in respect of, any claims, demands, actions, costs, expenses, losses and damages arising out of or in connection with or as a consequence of any of your acts or omissions in connection with any Course that breach these terms and conditions.

    4. Intellectual Property and Privacy
      1. Intellectual Property in Training Materials

        (a) Any intellectual property rights subsisting in training materials provided to you (Training Material) or software platforms used by you (Platform) in connection with any Course are either owned by, or licensed to, PGA for the purposes of providing the relevant Course.

        (b) You may use any Training Material solely for the purpose of undertaking the Course for which it was provided. You must not distribute, disclose, sublicense, copy, lease, sell or otherwise grant or transfer any interest in the Training Material to any person, except with the prior written consent of PGA.

        (c) You may access and use the Platform solely for the purpose of undertaking the Course in respect of which it is provided.

        (d) All right, title and interest (including intellectual property rights) in any new material created in connection with a Course by:

        (i) you will automatically vest in you, and you grant to PGA a non-exclusive, perpetual, transferable and royalty-free licence (with the right to sublicense) to use that material for its functions and activities; or

        (ii) PGA will automatically vest in PGA.

        (e) You unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of your moral rights in any new material created by you or PGA in connection with a Course and agree to not institute, maintain or support any claim or proceeding for infringement of any such rights.

      2. Privacy and intellectual property in Materials

You acknowledge and agree that:

(a) PGA will collect your personal information in connection with your participation in a Course, for example:

(i) when you submit a registration form; or

(ii) by photographing, filming or recording you;

(b) PGA can use and disclose your name, image and other personal information in any material, including promotional material (Material) in connection with its business and operations without any compensation to you;

(c) all right, title and interest (including intellectual property rights) in the Material will automatically vest in PGA on its creation;

(d) you unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of your moral rights in the Materials and agree to not institute, maintain or support any claim or proceeding for infringement of any such rights;

(e) PGA's privacy policy contains further information about how PGA uses, discloses and stores personal information. It also contains details about how you can access and seek correction of your personal information.

(f) In addition to the purposes set out in PGA's privacy policy, PGA may use and disclose your personal information:

(i) for promotional purposes; and

(ii) to contact you about:

(A) PGA training events;

(B) other PGA functions and events; and

(C) promotional material from PGA sponsors.
